Terms of Service

Who can use NEST IQ
To use the Service you must be at least 18 years old and have the legal capacity to enter into this agreement. The Service is intended for tenants, landlords and property managers/agents dealing with residential property in the United Arab Emirates. By using the Service you confirm that the information you provide is accurate and that you are authorised to provide it.
What the Service does
NEST IQ is a shared platform that both parties to a tenancy can use throughout the tenancy. Subject to your plan, it may include: shared move-in / move-out condition records; a RERA rent-increase reference calculator (NEST IQ Check); maintenance tracking; document storage; in-app messaging; renewal reminders; template-based legal notices; and Nia, our AI assistant. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own lawful rental purposes.
Artificial intelligence — how it works and its limits
The Service uses artificial intelligence, including large language models and computer-vision models supplied by third-party AI providers. You agree to the following before relying on any AI feature:
- How it works. When you use an AI feature, your inputs — for example the text of your question to Nia, or your condition-record photographs and notes — are sent to an AI model that generates an output (an answer, a suggested furnishings list, a shot-coverage check, or a photo comparison). For condition records, AI outputs are advisory suggestions that you review, edit and confirm; a human always finalises the record.
- AI can be wrong. AI-generated outputs may be inaccurate, incomplete, outdated, biased, or may "hallucinate" — meaning they can produce confident-sounding statements, figures, citations or details that are false or entirely fabricated. Outputs may vary between requests.
- Not advice; verify independently. AI outputs are provided for general information only and do not constitute legal, financial, valuation or professional advice, and do not create any professional or advisory relationship. You are solely responsible for checking any AI output against official sources (such as RERA, the Dubai Land Department or the Rental Disputes Centre) and for any decision you make. Do not submit passwords, full payment card numbers, or government ID numbers into AI chat.
- No liability for reliance. To the maximum extent permitted by law, NEST IQ is not liable for any loss or damage arising from your reliance on AI outputs. We do not warrant that AI features are accurate, error-free or fit for any particular purpose.
Condition records and digital signatures
Condition records are shared documents that both parties create and can digitally sign. When signed by both parties, a record reflects what those parties agreed about the property's condition at that time. NEST IQ is not an arbiter and does not validate, endorse or judge either party's position. A record is evidence, not a judgment.
Records, timestamps and signatures may be used as supporting evidence, including before the Rental Disputes Centre, but their admissibility and weight in any proceeding are determined solely by the competent court or authority — not by NEST IQ. We recommend you also keep your own copies of important photographs and documents.
NEST IQ Check (rent calculator)
NEST IQ Check provides an indicative rent-increase reference based on publicly available RERA data and Decree No. 43 of 2013. It is a guide only, may not reflect the latest official data or your specific circumstances, and is not an official determination. Always confirm figures using the official RERA rental increase calculator before relying on them.
Legal notices and templates
Where the Service helps you generate tenancy notices or documents, these are templates and informational tools, not legal advice, and NEST IQ is not a law firm. We do not guarantee that any notice is valid, correctly served, or enforceable in your situation. For disputes, evictions or formal notices, consult a licensed UAE lawyer or the Rental Disputes Centre.
Your responsibilities and acceptable use
You agree that you will not:
- use the Service for any unlawful purpose or to facilitate illegal activity;
- misrepresent your identity, your role, or property or tenancy details;
- upload content that is unlawful, infringing, defamatory, or violates another person's rights or privacy;
- upload another person's personal data without a lawful basis to do so;
- attempt to reverse-engineer, scrape, disrupt, overload or gain unauthorised access to the Service; or
- use the Service in any way that could harm other users or the integrity of the platform.
You are responsible for the accuracy and lawfulness of the content you submit and for maintaining the security of your account.
Your content and intellectual property
You retain ownership of the content you upload. You grant NEST IQ a limited licence to host, store, process and display that content solely to operate and provide the Service to you and, where applicable, to the connected tenancy party. All rights in the Service itself — including software, branding, and the NEST IQ name and logo — belong to NEST IQ and may not be used without our written permission.
Payments, subscriptions and refunds
The Service offers free and paid features. Paid plans are billed in AED via our payment provider, and prices are exclusive of VAT unless stated. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except where required by UAE consumer protection law, payments are non-refundable for partial periods. We will give reasonable notice of any price change.
Third-party services
The Service relies on third-party providers (including hosting, database, AI, payment and messaging providers) and may link to third-party websites or official portals. We are not responsible for third-party services or content, which are governed by their own terms.
Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service, or any AI output, will be uninterrupted, error-free, accurate, or that it will meet your requirements. Laws and official data change, and we cannot guarantee real-time accuracy.
Limitation of liability
To the maximum extent permitted by law, NEST IQ and its officers, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, deposits, data, goodwill, or outcomes of any tenancy or dispute, arising out of or related to your use of (or inability to use) the Service or any reliance on AI outputs. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable UAE law.
Indemnity
You agree to indemnify and hold NEST IQ harmless from claims, losses and expenses arising from your breach of these Terms, your misuse of the Service, or content you upload in violation of another person's rights or applicable law.
Suspension, termination and account deletion
We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. You may stop using the Service at any time and may delete your account from your account settings. Account deletion is subject to a 30-day recovery window, after which your data is permanently erased, except for records we are required or permitted to retain (see the Privacy Policy).
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Subject to any mandatory consumer rights, the competent courts of Dubai shall have jurisdiction over any dispute arising from or relating to these Terms or the Service. Tenancy disputes between landlords and tenants remain subject to the jurisdiction of the Rental Disputes Centre.
